    Apple website 'must admit Samsung didn't copy'

    Apple must put a notice on its website for six months acknowledging the recent ruling against Apple's claim that Samsung had copied its iPad design. The company must also put an announcement in several newspapers and magazines, Bloomberg reports.

    Richard Hacon, Apple's lawyer, said the order was prejudicial because the company was being forced to publish "an advertisement" for Samsung. He told the court: “No company likes to refer to a rival on its website.”

    Last week, Apple lost its case, at the High Court in London, in which it had claimed that the Galaxy Tab "slavishly copies" the design of the iPad. Judge Colin Birss said: “They do not have the same understated and extreme simplicity which is possessed by the Apple design."

    He added: “They are not as cool. The overall impression produced is different.”

    The court dismissed Apple's claim on the basis of two key differences between the Galaxy Tab and Apple's tablet. First, the court said the Galaxy Tabs were significantly thinner than Apple's iPad. Second, the detailing on the back of Samsung's tablets was distinctive and unusual.

    Judge Birss said "informed users" would be able to spot the difference between the two tablets.

    Apple has been locked in legal battles worldwide with manufacturers of Android handsets over the designs of their respective smartphones and tablet computers. While Apple has had some success over Samsung in the US and in Germany, it's defeat to Samsung over tablets is its second recent defeat in British courts.

    Earlier this month Apple lost a claim against HTC over four iPhone related patents. A judge ruled that HTC had not infringed on the patents, including one concerning the iPhone's slide-to-unlock feature.

    Apple was not available for comment at the time of publication.


    Apple is expected to appeal against the ruling.

    A Samsung spokesman said: "Should Apple continue to make excessive legal claims based on such generic designs, innovation in the industry could be harmed and consumer choice unduly limited."

    Samsung also applied for an injunction banning Apple from saying the Galaxy Tab copied its designs but Judge Birss did not grant it. He said: “They are entitled to their opinion that the judgment is not correct."

    I doubt this will make it through appeals.

    it will. courts here are very different to US of A. the above is goign to happen whether apple likes it or not

    I was talking about this case this morning with a friend who is a partner at a London law firm. He was convinced it won't happen.

    Just a suggestion as to the possible copy they will use.

    I will comment that it is telling that the best the UK judge could come up with on how the differ was to point out that the Samsung was thinner and had different details on the back of the unit. The back. For how much one spends looking at the back of a tablet, he might as well have said they looked different on the inside too.

    it's also worth noting that apple is going to have to pay for ALL of the advertising too
    These publications include the Financial Times, Daily Mail, Guardian Mobile and T3, and Apple will have to pay for the advertising.

    Wasn't that implied with the ruling? What did you think, that the newspapers would run the statements for free for months?

    But, yeah, paying for the ads is going to drive Apple into bankruptcy court.

    perhaps not. i guess to make the difference apple will further increase the number of sweatshops and child labour that they're famous for employing

    Your Samsung tablet cost you an extra $100 because of these types of lawsuits. Same goes for Apple.

    No doubt in my mind Samsung uses the same amount of sweatshops and child labor.

    You mean the Samsung plants most of their components come from? How dare you disparage Samsung.They even use the 'dreaded' Foxconn that Apple uses. Apple just gets the press because no one cares about Sammie. Also, because Sammy doesn't let anyone in to their plants for inspection and are known for covering up their suicides.

    Especially since Apple ripped off the iPhone form factor from an LG concept design that eventually became the Prada.
