Here's MY Story:
I phoned the ATTWS Corporate Office in Everett, WA (Business Hours Pacific Standard Time (Monday-Friday) yesterday 3/24/04 at 425-580-6000 pressed 9 for the operator and was transfered to a "Charlie" on the executive complaint team.
As the T226 was free and the T616 is significantly more expensive I agreed to pay $50.00 invoiced on my account in order to trade in the T226 for the T616 with NO contract extension.
I probably could have gotten the T616 for free but everybody on this forum keeps saying "T226 is free, what are you complaining about?" So the $50.00 seemed like a fair deal.
I received the T616 Airborne Express today 3/25/04 (less than 24 hours after speaking with the executive team) and I will actually be charged $68 because Charlie forget to mention the Sales Tax which is 8.25% where I live would be charged on the retail price. That's OK, I knew how that worked in the back of my mind anyway.
Charlie from the executive compliant team is sending me a label to return the T226 to ATTWS as my agreement was actually a trade-in credit.
Forum Member Jomale (who recently joined here from the censored ATTWS forums) did it in writing and had more steps - I will copy his story here as it is lost in the thread he posted it in:
"I finally made it here. Well folks, I got my 'upgrade' postcard about a month or so ago and called Sony ericsson and got nowhere. I then wrote a letter to the CEO of AT&T and waited for 2 weeks to get a response. In the meantime I called AT&T customer service when I saw a one-day only online deal offering a free T616 to new customers. I got a nice customer rep who was willing to work with me and for tax, shipping, and $15 upgrade fee I got a free T616. I had to renew my contract for 2 years, but to me that was not a problem since I have had no major issues with AT&T. A week later I was contacted by the executive response team at AT&T who were contacting everyone who wrote letters to resolve their particular issues. I explained to the rep my situation and my account was reimbursed for the upgrade, tax and shipping fees and my case closed. You need to write a letter to have this all resolved.
Here is the address I used:

I hope this information will assist all the forum members resolve their issues with ATTWS about the T68>T226 "upgrade" program.

PS So far the T616 is a big improvement all around over the T68i.
Another of the Forum members at AT&T's site, PDR, did it via email and also wrote a letter to the executive office and ended up with 2 free phones! Go figure. This 'upgrade' issue is being dealt with on a case by case basis. In my case, I was able to keep both the T226 and the T616. My older son now uses the T226 and it is a nice phone for his needs. I had purchased one for my younger son at Christmas. I incurred a 2 year agreement....PDR and MitchBart and another AT&T forum member, REM were not asked to renew or extend their contracts. In some cases tax and shipping and upgrade fee were charged! We all were resolved in different ways!
Taking Jomale's advise I wrote a letter to John Zeglis last night and sent it UPS Next Day this morning. He should receive it Monday AM. I will post any responses I get from ATTWS.
I actually have two T68is' and got two postacrds and two text messages. Like others I have a heavy investment in Bluetooth including two Bluetooth car handsfree, and a Bluetooth headset, as well as other Bluetooth enabled devices. My monthly billing is small, about $95 per month and I don't expect to get a T616 for free, but I do not want to extend my contract. We shall see what happens.
Well, I just tried, was transferred to an executive escilations person as well, but was told without a contract extension and the normal upgrade rules I couldn't get anything but the T226.

Did you ask for the T616 for free? I suggested $50 upfront with NO contract extension so maybe that's why they went for it?
BTW I'm on a month to month $79.99 GSM Charter Plan. I don't know if that had an impact on the agreement.
Im on a $70.00 a month GSM plan and I stated plain and simple that I am unhappy with what they call an upgrade and would be more than willing to pay 50-60$ for a T616 but dont want to have to extend my contract. She stated that they ONLY way to get a T616 is following normal AT&T upgrade policy and told me "Use your T68i, its not a crap phone, most likely the 850 overlay wont even help much so just be happy with your free new one but use the T68i for its features if it still works".

Very interesting, once again unequal resolution of customer service problems.
I suggest that when you write the letter that you mention you know about the agreement others have received for the Executive Team. I would also close with something about considering "porting" your number and taking your business to Cingular or Verizon weather you mean it or not at the end of your current contract if you have one.
ATTWS is "bleeding" customers and every loss (even to Cingular) decreases the value of the acquistion agreement with Cingular which or course put the agreement at risk.
I thought a different building was the world's largest by volume. I looked it up.

The world's most capacious building is the Boeing Company's main assembly plant in Everett, Washington, USA. Completed in 1968, it has since been expanded to 13.4 million cu. m. (473 million cu. ft.).
I was able to call the executive complaint dept. and get a 616 for $75 with a 1 year extention. So not as good of a deal as some of you guys, but fine with me. I wasn't going to press the issue since I thought it was fair enough.

Yes it is pretty huge...
and MB yes the reason you did not have to agree to a new contract is because your plan is expired and there is no way to gurantee you would have those additional minutes for the next 2 years. Just be sure to read your bill messages because eventually they will be taken away.
If you call ericsson at 1800ERICSSON and explain that you're using the T68 because of the bluetooth technology AND you travel abroad and need the international roaming capability, then SonyEricsson will replace the 226 with a 616, free of charge.
