This is Massonite. I got banned the other day for something absolutely stupid, and then it was extended further simply for exercising my freedom of expression. So I decided to create a new username so I could get something off my chest regarding this whole MobiTV pinch fight. I don't care if I get permanently banned over it, I'm fed up with the BS that is HowardForums.
I find it very funny, yet pathetic that everyone is sympathizing with this website over this issue. The fact is, all they had to do is delete the links. I know someone who was banned for posting links to movies, and the threads deleted. Why? Copyright infringement. Same as this one.
People also get banned in a heartbeat around here just for saying something like a$$ or some other creative way of spelling a curse word. Oh no, circumventing a swear filter! What happened to the freedom of expression that you're whining about over this MobiTV issue? Doesn't work both ways? Does it only count if it works in your favour? You're going to put up a thread crying about a cease and desist order just because you're too stubborn to delete a link that you shouldn't even have up anyway? Yet you'll ban me for saying a bad word, or others for posting similar links? Does anyone else see a double standard here?
So go ahead and ban me for life. I don't care anymore. You'll just be proving once again that as long as it's you behind the 8 ball, freedom of expression stands tall and proud and everything is ok, but if anyone else expresses that same freedom, you come down on them like that same freedom does not exist.

Darned Expanded Use Number. Guess I'll have to wait 'til tomorrow to go premium and support the fight.
But I'll be adding the "solidarity sig" in a minute, and Howard, you got 800k members behind you. Bet MobiTV doesn't have that many customers, heh. Now they'll be boycotted, or better, their servers sapped by people downloading their streams until they fix the glaring flaw that makes their service seem like it's from 1996!
Wait a minute...the stream is only 38 kbps...the quality is too lousy to sap their servers and too lousy to watch or buy anyway! They should offer it for free and make it ad-supported or something...so either fix your encryption or change your business model MobiTV and stop being like the RIAA!
Oh, and another server suggestion: FDCServers.com. They can handle HoFosized traffic with no problems, and their uptime is pretty decent too. They actually have more bandwidth coming into their system than The Planet!

The service seriously sucks anyway. They should be praising the info posted for the advertising. Unless you are using the service on wifi, (the actual software, along with a trial renewal crack is available on another site lol) all you get is choppy service. As for a supposed company that leaves their urls unprotected in such a way, that is just damn sad. Take the cash they are spending on this, which is just making them look bad, and put it towards hiring a competent team to protect their services from access they do not desire.
All they have done now is ensure those links will be available to more people then ever.

IANAL, but clearly MobiTV will lose out big time for the choices they've made. From what I remembered and what Googling about deep linking popped up, it looks like they might have some basis in the law though. Ignoring international issues, their case seems similar to the supercross case back in 2006 where a website was granted a preliminary injunction against another site that linked directly to audio webcasts without permission. That, the Google / Perfect 10 case, and the DeCSS / 2600 case leads me to believe that Howard should probably at the very least remove any actual links to MobiTV's site and replace them with plain text. This would also have the added benefit of removing any referrer links coming from HoFo. Leave the rest of the info intact and it likely becomes more of a 1st Amendment issue.
This is just a bogus threat made by an incompetent company too idiotic to secure their feeds.
If anything, they should feel the backlash for this from investors and TV companies who put their trust into MobiTV.

I find this astonishing – in my line of work we can’t uplink anything on Ku without the content providers IP integrity guys approval and audit and unless it is scrambled with Motorola Digicipher II.
I am blown away that the content owners would even allow this, these guys should have kept quite because all the attention their Hofo attack will attract will also attract the interest of the content providers who have more lawyers than they do.
Signal integrity is the primary obligation of the distributor in just about any carriage agreement. This would be as though I were to uplink HBO in clear MPEG-2 on a Ku satellite that any slob with an 18” dish could then receive.
They are sure to regret bringing attention to this,
