    New CRTC Report Calls for Internet Taxation & Regulation in Canada

    A new report from the CRTC is seemingly at odds with the net neutrality rules just enshrined in law. Previous research on promoting Canadian old and new media content recommended an export-oriented strategy, but that seems to have changed. As Micheal Geist reports:

    The CRTC has reversed that approach with a regulation-first strategy that envisions new fees attached to virtually anything related to the Internet: Internet service providers, Internet video services, and Internet audio services (wherever located) to name a few. The CRTC’s report now goes to the government, but this has the feeling of theatre with a review of telecom and broadcast legislation set to get underway with a panel that will undoubtedly include several proponents of an Internet regulation strategy.
    When it comes to the idea of an Internet tax I myself don't think it's unreasonable for Netflix and Spotify to collect HST. Where it gets problematic is with this country's two largest Internet providers (Bell and Rogers), who also happen to be deeply invested in the creation of Canadian content. They would both collect and benefit from an Internet tax, which seems to me like a conflict of interest.

    As for regulation I strongly disagree that there is even a "Canadian content emergency" at all; it's never been easier to find Canadian content via Spotify, Netflix and, for that matter, podcasts and YouTube as well. And any deficiency in CanCon on movie screens or broadcast TV has more to do with the creative brain drain to the Hollywood than any lack of protectionism in this country for those legacy industries.

    I'm posting about this here because it would potentially affect all Canadians, on mobile or otherwise. More news as it develops...

    A student a the University of Guelph has been fined $400 CAD for distracted driving, with the presiding judge ruling that an Apple Watch qualifies as a handheld device.

    The student was stopped at a red light when a campus police officer pulled up beside her. The officer saw her head facing downwards and a glow from an electronic device lighting up her face. She failed to proceed when the traffic light turned green and was charged on the spot with driving while holding a handheld communication device, prohibited under the Province of Ontario's Highway Traffic Act.

    After the case was heard in court the justice wrote the following in his ruling:

    “Despite the Apple Watch being smaller than a cellular phone, on the evidence it is a communication device capable of receiving and transmitting electronic data. While attached to the defendant’s wrist it is no less a source of distraction than a cell phone taped to someone’s wrist. It requires the driver to change their body position and operate it by touch.”
    The student pleaded that she was only checking the time—which she's either really bad at or is lying about altogether. The only thing I can say in her defence is that checking the time on a smartwatch would indeed be easier if that smartwatch had an always-on display.

    If you're a fan of Android and software freedom I've got some bad news for you this morning.

    The first is that Essential has apparently cancelled their second-generation smartphone. Bloomberg broke the story yesterday afternoon, going so far as to say that the entire company might soon be up for sale. CEO (and father of Android) Andy Rubin quickly took to Twitter for damage control:



    I can't say that I was a fan of the Essential phone—I had a brief hands-on at a Telus-sponsored event last August—but I certainly appreciated its unlockable bootloader. Whatever Essential's future plans may be, for the moment they don't seem to include modder-friendly phones.

    Speaking of unlockable bootloaders, here's some more bad news from Twitter:



    If you weren't aware, Mr. O'Brien is a UK-based Android developer responsible for the once-popular MoDaCo ROM. Sadly, his news is true: one of the world's top 3 smartphone OEMs will no longer give its users the keys to take control of their devices.

    And the war on general-purpose computing continues...

    This Canadian won't pretend for a moment to be an expert on U.S. politics, yet I feel obliged to report on the latest bizarre twist in the story of the growing American ban on Chinese smartphones.

    A quick refresher: This past January, AT&T abruptly pulled out of an agreement to be the exclusive American carrier for the Huawei Mate 10 Pro; Verizon also announced that it would no longer carry Huawei products. In February, the heads of six U.S. intelligence agencies expressed "deep concerns" about Chinese-made telecom products to the Senate. In March, Best Buy halted all sales and any future orders of Huawei hardware. In April, the Department of Commerce banned U.S. companies from exporting components to ZTE for seven years. As a result, ZTE ceased its main business operations earlier this month.

    And then yesterday, President Trump suddenly and unexpectedly tweeted that he was working President Xi Jinping of China to get ZTE "back in business". But why?

    I believe the answer lies within the nature of the ZTE ban. First there are the specifics: the ban was initiated because ZTE failed to punish employees who violated trade controls against other nations. Second are the political stakes: The New York Times reports that China is acting as an intermediary in talks between North Korea and the USA. Reversing policy on ZTE might help secure China's continued involvement.

    But here's what's most telling to me: According to Reuters, ZTE paid over $2 billion to U.S. exporters last year, including $100 million each to Qualcomm, Broadcom, Intel and Texas Instruments. So banning ZTE would adversely affect not only Chinese jobs, but jobs in the USA as well. Huawei, on the other hand, has its own Kirin chipsets, and is therefore far less reliant on Qualcomm, at least.

    Which makes me wonder whether this whole China scare is less about security and more about trade. What do you think?
