    Yep, there's no legal instrument for the Feds to unbake this cake. The merger is a done deal.

    Interestingly, there aren't really many penalties baked into the deal. The Feds basically just took it on face value that T-Mo will stick to any of the promises they made. The exception was the population coverage guarantees- those are backed by mild penalties (which, of course, are far lower than the cost of actually building out the network to meet the guarantees, so T-Mo *could* in theory make the business decision to "punt" to save money and pay the penalties.)

    At the risk of being accused of "bashing" with another "anti-T-Mobile post", I'm not suggesting T-Mo *will* break any of their promises- in fact, it'd probably be a PR blunder to break the pricing promises in particular. I'm just saying the guarantees they made to the Feds are largely unenforceable, the penalties toothless, and large corporations have certainly wiggled out of unenforceable promises made to seal mergers before. Honestly, the deals T-Mo made with the individual states to settle the lawsuit were probably far more likely to hold T-Mo's feet to the fire than anything the Feds required.

    And the coverage commitments are so low, they're easy to satisfy.

    From another post, the CPUC approved the merger. So, the final legal hurdle has officially been cleared. There are no more straws at which anyone can grasp.
